Article 1. Seller

These general terms and conditions of sale (the “T&Cs”) are those of the company MALFROID (“MALFROID”), a limited liability company (société à responsabilité limitée) with a share capital of €900, whose registered office is at 7 rue Villebois-Mareuil, 75017 Paris, France, registered with the Paris Trade and Companies Register under number 840 710 644 (SIRET 840 710 644 00021), intra-community VAT number FR24 840 710 644. Telephone: +33 (0)9 66 93 87 25. Email: contact@malfroid.com.

Article 2. Scope

The T&Cs apply to any order for MALFROID brand products (the “Products”) placed on the website www.malfroid.com (the “Site”), whatever the country of delivery.

The Products are intended for end consumers. Their resale or distribution is prohibited. The customer declares that they are acting as an end consumer and have the capacity to enter into a contract.

MALFROID may amend the T&Cs at any time. The T&Cs that apply are those in force on the date of the order. They are available at the bottom of the Site’s pages.

Article 3. Ordering

The Site allows you to order the Products online. You can also order by telephone on +33 (0)9 66 93 87 25, Tuesday to Saturday, 10:30 am to 7 pm (Paris time).

The Site does not allow special orders (creation, adaptation or personalisation of a Product). For such requests, contact Customer Service or a store.

To order, you add the Products to your cart, check the summary (Products, sizes, quantities, prices, delivery costs), enter your contact details and delivery address, then confirm your order and its payment by clicking the “Pay now” button. The sales contract is formed at that moment. You then receive an order confirmation by email, which sets out the Products, the total price, and the delivery costs and lead times. We recommend that you keep it.

The information you provide must be accurate and complete. You can create a customer account; you remain responsible for the confidentiality of your login details and must inform us without delay of any fraudulent use.

MALFROID may refuse an order in the event of an ongoing dispute with the customer, a breach of the T&Cs, suspected fraud or any other legitimate reason.

The data recorded by MALFROID is authoritative between the parties. For orders of €120 or more, MALFROID keeps the written record of the contract for ten years from delivery. You can access it on request from Customer Service.

Article 4. Availability of the Products

Offers and prices are valid as long as they are visible on the Site, while stocks last. If a Product becomes unavailable after your order, we will notify you by email or telephone and offer to replace it with another Product or to cancel the order. In the event of cancellation, you are refunded all sums paid.

MALFROID may limit the quantities purchased per customer and change the Products offered at any time.

The photographs and colours displayed on the Site are as faithful as possible, but your screen may alter how they appear.

Article 5. Prices

Prices are shown in euros, inclusive of all taxes, including French VAT, for deliveries in France and the European Union. For deliveries outside the European Union, French VAT is applied or not depending on the destination country, as indicated before the order is confirmed. Customs duties and local taxes may apply (article 10).

Delivery costs are shown separately, before the order is confirmed (article 9).

MALFROID may change its prices at any time. Products are invoiced at the price displayed at the time of the order. If a displayed price is manifestly erroneous, MALFROID is not required to deliver the Product at that price, even after the order confirmation has been sent.

Article 6. Payment

Payment is due immediately, at the time of the order. The accepted payment methods are those offered at checkout (bank cards and digital wallets, depending on your device). Payment is processed by our secure payment provider; MALFROID does not have access to your full card numbers.

The order amount is charged when the order is confirmed.

The order is shipped only after payment has been validated. If an ordered Product is unavailable, MALFROID will contact you and, if the order is cancelled, will refund the sums charged.

Article 7. Gift cards

MALFROID gift cards, purchased in store or on the Site, are valid for 12 months from the date of purchase. They can be used in all MALFROID stores as well as on the Site. They cannot be exchanged for cash and are not refundable. In the event of loss or theft, MALFROID cannot replace them.

Article 8. Retention of title and risk

The Products remain the property of MALFROID until the price has been paid in full. The risk of loss or damage passes to you when you, or a third party you have designated other than the carrier, take physical possession of the Products.

Article 9. Delivery

9.1 Countries served. We deliver to mainland France and Monaco, to the countries of the European Union and to many other countries. The list of countries served appears when you order; if yours is not listed, please contact us. We do not deliver to countries or territories subject to sanctions or an embargo, nor to a P.O. box or a post office.

9.2 Carrier and delivery methods. The Products are shipped by Chronopost. Depending on the country, you can choose home delivery, hand delivery against signature (if you are not at home, the parcel is left at a nearby pick-up point), or delivery to a Pickup relay point. You can also choose, at checkout, free pick-up in one of our stores. If the Product has to be transferred from another store, the time it takes to be made available is shown at checkout. An email lets you know as soon as the order is ready.

9.3 Delivery costs. They depend on the destination country and the method chosen, and are displayed before the order is confirmed. Free delivery offers may occasionally be made available; they are then specified on the Site.

9.4 Lead times. The indicative lead times below run from the confirmation of the order. They may be extended, in particular depending on the delivery address, in Corsica and overseas, or in the event of circumstances beyond our control (article 15).

Destination Indicative lead time
Mainland France and Monaco 3 business days
European Union 6 business days
Other countries, French overseas territories up to 8 business days, excluding customs clearance times

9.5 Delay. In the event of a delay, you may formally require us in writing to deliver within an additional reasonable period. If delivery does not take place within that period, you may cancel the order by email or by registered letter sent to MALFROID, 7 rue Villebois-Mareuil, 75017 Paris. We will then refund all sums paid no later than 14 days after the cancellation. If you nevertheless receive the Product, you must return it to us (article 12).

9.6 Checking on receipt. Check the condition of the parcel on delivery and state any reservations to the courier if there is an anomaly (opened parcel, damaged Product). Then notify Customer Service as soon as possible.

9.7 Unclaimed parcel. If the parcel is returned to us because it was not collected or received, the costs of re-shipping or returning it are at your expense and may be deducted from any refund.

Article 10. Customs duties, taxes and formalities

10.1 Mainland France, Monaco and the European Union. No customs duties are payable.

10.2 Deliveries outside the European Union. Customs duties, taxes, and clearance and formality costs set by the destination country may be added to the price and the delivery costs.

Depending on the destination country, they are calculated and added to your order at checkout: their amount is then itemised before you confirm, and you have nothing to pay on delivery.

For other countries, the customer is the importer: these sums must be paid on delivery or before the parcel is handed over, to the carrier or the local authorities. MALFROID cannot know the amount in advance: please check with your country’s customs authorities before ordering. If these sums are not paid and the parcel is returned to us, the outbound and return costs are at your expense and are deducted from the refund of the price of the Products.

10.3 Overseas territories. In the French overseas departments, regions and territories, local taxes (octroi de mer, local VAT depending on the territory) and customs clearance costs may apply; article 10.2 applies.

Article 11. Right of withdrawal

11.1 Time limit. You have 14 days from receipt of your order to withdraw, without having to give a reason or pay any penalty (articles L.221-18 et seq. of the French Consumer Code). In the case of in-store pick-up, the period runs from the date you collect the order. MALFROID grants this period to all its customers, whatever their country of delivery.

11.2 How to withdraw. Use the online form on the “Return request” page (malfroid.com/pages/demande-de-retour), available at the bottom of the Site’s pages and which serves as the model withdrawal form, or send an email to contact@malfroid.com, or a letter to MALFROID, 7 rue Villebois-Mareuil, 75017 Paris. An acknowledgement of receipt is sent to you by email. You must then return the Products to us within 14 days of your request (article 12).

11.3 Exceptions. The right of withdrawal does not apply to personalised orders (bespoke patinas, marking, special orders) nor to shoe repair or care services that have already been performed (article L.221-28 of the French Consumer Code).

11.4 Condition of the Products. Shoes must be returned to us unworn outdoors, with no signs of wear on the sole, with their accessories, in their original box and packaging. We recommend trying them on over a rug or carpet. You are liable only for any diminished value resulting from handling other than what is necessary to establish the nature and characteristics of the Products (article L.221-23). If the original shoe box is missing or damaged, MALFROID may deduct €15, corresponding to the cost of replacing it. If the shoes show signs of wear, MALFROID may deduct an amount proportionate to the diminished value found, which may be nil.

Article 12. Returns, exchanges and refunds

12.1 In store. You can bring your pair back to one of our stores, in Paris or Lille, on presentation of your invoice. For an exchange, within 14 days of delivery, the form is not required; for us to set the new pair aside, state the model and size in the form by selecting “Return in store”. For a refund, first make your request using this form, then bring the pair back within the time limits of article 11.

12.2 By post from mainland France or Monaco. One return per order is free of charge. After your online request, you will receive a return label by email. Put the pair back in its original box, then in a cardboard box (if you reuse the delivery box, remove the old label), stick on the label and drop the parcel off at a post office or a Chronopost relay point. Keep your proof of postage until you have been refunded. Additional returns on the same order are at your expense, unless they are made in store.

12.3 By post from another country or the French overseas territories. Return costs are at your expense. After your online request, send the parcel to: MALFROID, 7 rue Villebois-Mareuil, 75017 Paris, France. We recommend declaring it as “returned goods” to avoid customs charges, choosing the same carrier as for the delivery if the country applies customs duties, and having your proof of postage stamped. Customs charges relating to the return are not covered by MALFROID.

12.4 Risk of the return. For a return that you arrange yourself, the risks of transport are borne by you; we recommend a tracked and insured shipment.

12.5 Exchange. After we receive and check your return, the new pair is shipped to you at our expense for mainland France and Monaco, subject to availability. If the model chosen costs more, we will ask you to pay the difference; if it costs less, the difference is refunded to you. For a gift, only the customer who purchased it may request a refund.

12.6 Refund. Once the parcel has been received and checked, we confirm this to you by email. The refund is made no later than 14 days after we receive your return, to the payment method used for the order and in the same currency. It covers the price of the Products only; shipping costs are not refunded. Depending on your bank, it may appear on your account up to ten business days later. Unless you request otherwise, no credit note is issued.

12.7 Purchases in store. Products purchased in store cannot be returned, exchanged or refunded via the Site.

Article 13. Legal guarantees

13.1 Legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code). MALFROID is liable for any lack of conformity existing at the time of delivery of the Product and appearing within two years of delivery. For 24 months, the defect is presumed to have existed at delivery, unless proven otherwise. You choose between repair and replacement, unless that choice entails a manifestly disproportionate cost for MALFROID. Failing that, you may obtain a price reduction or termination of the contract. These measures are free of charge to you.

13.2 Guarantee against hidden defects (articles 1641 to 1648 of the French Civil Code). You may bring a claim within two years of discovering the defect, and choose to return the Product against a refund of the price or to keep it against a partial refund of the price.

13.3 Defective or non-conforming
